Unlimited liability demanded for doctors COLUMBIA (AP) A woman whose husband died after surgery by a Navy doctor, who later was convicted of negligent homicide, asked state senators Tuesday not to limit the liability of physicians. "He's gone at the hands of an incompetent surgeon," Lili S. Grubb of Lancaster said about her husband, Maj. William Franklin Grubb Jr.

Grubb, 73, died on Aug. 8, 1984, after Dr. Donald Billig performed a triple bypass operation on him. Billig has been convicted of negligent homicide in the death of Grubb, involuntary manslaughter in the deaths of two other people and 19 counts of dereliction of duty. He was dismissed from the service and sentenced on March 3 to four years in prison.

"They ought to pay," Mrs. Grubb said, with tears in her eyes. "They ought to make life a little better for those who are left to struggle on." she said. She spoke before the Senate Judiciary Committee, which is considering a bill that would put a limit of $100,000 on doctors' liability for such things as pain, suffering and loss of companionship. An attorney for Mrs.

Grubb, William Harper of Raleigh, N.C, said Tuesday he has prepared a lawsuit against the federal government asking for unspecified damages for Grubb's death. The suit probably will be filed later this week in U.S. District Court in Greenville, he said. A South Carolina law concerning medical malpractice would not affect Mrs. Grubb's claim since it is against the federal government, Harper said.

Mrs. Grubb, a retired nurse, said she appeared before the committee because she cares what happens to patients and to victims of malpractice. Bonnie Jean wanted people to know that she had accepted Jesus Christ as her personal Lord and Saviour, and after being sick for many months, the Lord answered her prayer and took her home to be with Him. COLUMBIA (AP) Negligence was at least partially to blame for last month's death of a 9-year-old retarded girl who strangled on wheelchair restraining straps at Midlands Center, Richland County Coroner Frank Barron III says. Barron at first ruled the girl's death on Feb.

24 was accidental. But he said on Monday that negligence contributed to the death. The coroner's opinion followed a Richland County Sheriff's Department investigation that determined the restraining straps weren't tightened securely enough around the severely handicapped girl. She died at Midlands Center, a state Department of Mental Retardation home in Columbia. Hope McFarland, who had an IQ of less than 20, slipped in her specially made wheelchair and choked to death on a shoulder harness.

The chair had a shoulder harness, a seat belt and loops for her feet because she could not sit upright without help. A nurse was unable to revive her with cardiopulmonary resuscitation. "There was some negligence on the part of whoever was responsible" for securing straps on the girl, Barron said Monday. "This was somebody who made a mistake and should be reprimanded." coroner said pelvic restraints had been prescribed by a physician in January, after Miss McFarland slipped in her restraints and suffered a superficial cut on her chin. Barron said he still feels the death was accidental, and therefore there is no need to hold an inquest.

"In my judgment, there was no criminal negligence," Barron said. "This was somebody who made a mistake and should be reprimanded. It was an accident. There's no region to hold an innuest." In Tuesday's decision, the Supreme Court said that there was insufficient evidence to show that the young man had consented to his name being published in the article. The court did not rule on a contention by The News that the lower court judge had erred when he charged the jury that a minor cannot consent to an invasion of his privacy.

The lower court jury had awarded the man $1,500 actual damages and $25,000 punitive damages..
